Chelsea & Fulham Tutors is an employment agency as defined in Section 13 of the employment agencies act 1973 and conduct of employment agencies and employment businesses regulations 2003.
Our agency operates under the guidelines for an Employment Agency as set out by The Tutors’ Association here:
Contract
We are an Employment agency, where our tuition company introduces a Tutor to work directly for a Client, taking a fee/commission from the Client in return. Once a tutoring position has been confirmed, the Client is entering into a contract between the Client and the Tutor, as well as a separate contract with Chelsea & Fulham Tutors. The Tutor is self-employed and not in an employment relationship with Chelsea & Fulham Tutors which should be noted by the Client. Chelsea & Fulham Tutors acts as an agent on behalf of the Tutor and will set up an introduction between the Tutor and Client. Chelsea & Fulham Tutors does not provide tutoring services.
Fee Payments
The billing process will be under the control of the Tutor. The Client will be sent a statement for payment via Stripe Connect after each tutoring session. The hourly fee quoted includes the Tutor’s fee and Chelsea & Fulham Tutors’ own fee/commission relating to its administration and introduction commission. Stripe Connect automatically splits the Client’s payment between the Tutor and Chelsea & Fulham Tutors. Chelsea & Fulham Tutors will not directly or indirectly make payments to the Tutor.
Should you wish to recommend one of the Tutors of Chelsea & Fulham Tutors to any other Potential or Actual Client, that Client must contact Chelsea & Fulham Tutors to make a booking through the agency.
Cancellation policy
Tutorials that are cancelled by the Client with less than 48 hours’ notice are charged for in full. Please note that where a Tutor is booked for a number of hours, we expect that the contract will be honoured by the Client.
For residential placements, please ensure that you and your Tutor are agreed on the arrangements for each position. Residential placements that are cancelled by the Client with less than 14 days’ notice are charged for in full. Please note that where a Tutor is booked for a number of days, we expect that the contract will be honoured by the Client.
Tutor’s performance
Chelsea & Fulham Tutors supplies each Tutor in good faith and in the belief that he or she will perform to the best of his or her abilities. However, we cannot guarantee and are not liable for the performance of the Tutor. If a Client has a complaint against Chelsea & Fulham Tutors, we regard it as a point of contract that we are informed within 24 hours of the occurrence that gave rise to the objection. Chelsea & Fulham Tutors cannot try to solve disputes between the Tutor and the Client.
Liability
Chelsea & Fulham Tutors do not accept any liability for any claims by the Client arising out of or related to the carrying out of the tutoring by a Tutor introduced by Chelsea & Fulham Tutors.
VAT
We are not currently VAT registered.
